Man To Be Jailed For House Break-in of Former Pottstown Swinger Friends

An Upper Pottsgrove man will face jail for a 2009 home break-in incident of his former friends that he met in a swingers' website.

After losing his appeal in the Pennsylvania Superior Court, an Upper Pottsgrove man will go to jail next month after being convicted of burglarizing the Pottstown home of a couple he knew from a swingers’ website, according to The Mercury.

In a 2010 non-jury trial Wayne Matthew Rafferty of Mauger’s Mill Road was convicted of charges relating to burglary and sentenced to jail.  He found out in Montgomery County Court on Wednesday that the Superior court denied his appeal and he was to serve his sentence.

“We took this case to trial because we had the evidence and I’m happy that the Superior Court affirmed the verdict.  Now, it’s only appropriate he serve the sentence for the crime he committed,”  said Assistant District Attorney Alec O’Neill.

Rafferty was sentenced to six to 23 months in the Montgomery county jail, and then three years of probation for the 2009 break-in incident at the North Price Street Pottstown home of his former friends he met on a swingers’ website.

Judge Rogers said that Rafferty, who will go to jail on Sept. 3, will spend the first 30 days of his sentence in jail, and the remainder on house arrest.  Further, Rafferty is to complete any counseling that may have been recommended, he is to stay away from the victims, and he is to pay them a restitution of $2,791.

The criminal complaint indicates how the victims met Rafferty and his wife, that they had communication through a swingers’ website and that “they began a consensual adult sexual relationship with Wayne Rafferty and his wife.”

According to the victims, some of the items that were stolen include two laptops containing nude photos of the victims, Rafferty, and his wife, undergarments, 15 to 20 bottles of wine, sex toys, and a crepe maker.
